This is really unfortunate for Radiohead and bands like them. The crusher is, when Radiohead released most of their early works, in fact just about everything before In Rainbows, digital downloads were not a popular medium so it was not included in their contract. So, digital downloads of most Radiohead albums don't garner a single penny for the artists themselves, since the company owns the rights to digital distribution. In case anyone's curious, this is Thom Yorke's response as posted on their website: for your information>>> we did not ask for a load of cash from our old record label EMI to re- sign. that is a L I E. The Times in the UK should check its facts before it prints such dirt. whAT we WANTED WAS some control over OUR WOrK and how it was used in the future by them- that seemed REASONAblE to us, as we cared about it a great deal. Mr Hands was not interested. So neither were we. We made the sign of the cross and walked away. Sadly. We are extremely upset that this crap is being spread about. To bedigging up such bullsh*t, or more politely airing yer dirty laundry in public, seems a very strange way for the head of an international record label to be proceeding. On a happier note we took no 'BRead-HEAd' advances at all from both independent labels XL and TBD for our new record. So judge for yourself. AND we are really excited to be working with them. SHock! Sadly Dick that is common and standard: copyright of the recording will generally be owned by the record company and that is binding for legally 50 years after its initial release unless a speciic provision is written into the contract for reversing those those rights at some specified date. The 50-year period is not defined or mentioned in the contract itself, but covered by copyright law - which the artist may or may not be aware of. Contracts can also have lock-out clauses that prevents the artist from re-recording the tracks at a later date.
Whoever signed the contract wasn't a berk, just in a very weak bargaining position. ------------- What? |

^True words Dean. I just check 6 random 2007 releases (self released excluded) and for only one of them does the band own the copyrights - Mar de Robles. All others are copyrighted to the record companies.
