Radiohead became an independent band this year because EMI chief Guy Hands refused to resign them because they would have cost the company £10 million, UK newspaper The Times has revealed.

We sold 25 million records and we have the moral rights over those six albums. We wanted a say in how they are exploited in the future. We were not seeking a big advance payment, or a guaranteed marketing spend as discussions never got that far."

EMI will have control of the 6 Radiohead albums for the next 50 years.

Their latest album 'In Rainbows' was available as a pay-what-you-like download. The band sold more than one million downloads under the experiment.

The album is officially released independently in Australia today and in the USA next Tuesday.

I find it worrying that Guy Hands is now in charge of EMI anyway. This is a man who specialises in corporate takeovers and (correct me if I'm wrong) has no real experience of the music industry.

Scary indeed. The quote in the Undercover above, and the ridiculous amount of time EMI will be in control over these albums says it all.

You said it best, this is the music industry.
Luckily they got out while they could and hopefully the In Rainbows release will cause labels to reconsider their pricing and their policies.

This is really unfortunate for Radiohead and bands like them.

The crusher is, when Radiohead released most of their early works, in fact just about everything before In Rainbows, digital downloads were not a popular medium so it was not included in their contract.
So, digital downloads of most Radiohead albums don't garner a single penny for the artists themselves, since the company owns the rights to digital distribution.  Particularly unfortunate since all of their albums are still relevant and popular.

Radiohead albums actually aren't available on any internet downloading service to the best of my knowledge.

OK that may be true, but it's a legal possiblity and it does extend beyond Radiohead.

ahhh be prepared for a 'Best Of' Radiohead comp in the next 2 years..........EMI is sure to continue to milk the catalogue for all it's worth (which is a helluva lot)......

On a happier note we took no 'BRead-HEAd' advances at all from both independent labels XL and TBD for our new record.

So judge for yourself.

AND we are really excited to be working with them. SHock!

AT least they do not behave like confused bulls in a china shop.

Clap Clappies for Mr. Yorke. When I posted this,I didn't really look at the amount of money they were presumably asking for - it's the reaction of EMI and Guy Hands that made me jump.

Sadly Dick that is common and standard: copyright of the recording will generally be owned by the record company and that is binding for legally 50 years after its initial release unless a speciic provision is written into the contract for reversing those those rights at some specified date. The 50-year period is not defined or mentioned in the contract itself, but covered by copyright law - which the artist may or may not be aware of. Contracts can also have lock-out clauses that prevents the artist from re-recording the tracks at a later date.
 
Whoever signed the contract wasn't a berk, just in a very weak bargaining position.

^True words Dean. I just check 6 random 2007 releases (self released excluded) and for only one of them does the band own the copyrights - Mar de Robles. All others are copyrighted to the record companies.

Since then, Radiohead released their 7th album 'In Rainbows' on online with a revolutionary new business model. They allowed fans to pay whatever they wanted for the album.

Yorke says this whole EMI/Hands thing in the press is upsetting. "We are extremely upset that this crap is being spread about. 'In Rainbows' is released this week through independent label XL Recordings. Yorke says that the band did not take an advance from XL for the deal.
