.... without selling it? I'm planning to do a cover of M. Colombier's "The Hope" on guitar and devices but don't know if to put it on a myspace. It certainly is not for sale but wanted to know if it's legal

I don't know if it changes in different countries or not Chus. I suspect though you would be as well to at least seek permission, especially if you are going to make it available on the net (even at no cost).

 And about it, I still think that one might need to seek permission for them to claim royalties for profits. I might ask Ivan as he is a lawyer graduate (I'm just a student 2nd year); although I'm not sure if he handles these kind of matters

I always thought it was theoretically illegal to play someone else's song without permission (e.g. in a pub band) although it is very unlikely that anyone would be prosecuted for doing so. If you put it on Myspace, in theory people could record it and sell it in which case you would probably be infringing copyright.

 Yes you're probably right; but there's the doubt that the one who violated the law was the person who released it or the person who recorded it and sold it.

In an establishment that offers live music, they pay a fee to AASCAP and BMI. That is supposed to cover the copyright problem. If you put it on the net, it could be considered a broadcast, and therefore an infringement. I wouldn't chance it.

As I toild you omn a PM Chus, if you live in one of the 163 countries that signed the Berne Convention, it's illegal because the article  6 says:

The text doesn't mention if there must be profit or not.

So unless you live in a country not mentioned there (Not your case being from Venezuela) and you're modifying the work of a musician from another country not mentioned there you're fried, so not being your case, better ask permission.

Yes you're right Bob, there are 192 nations recognized by the UN (This makes 193 because the Vatican has chosen not to be a member of the UN and one that used to be a country but no longer is Taiwan) but not sure how many more not recogtnized there are, because every day a small country appears somewhere splitting from an already small country.
 
Most of the countries that have not signed the treaty are those who are in terrible civil wars and have other issues to worry about.

Vatican is not part of the UN (To avoid political participation), but it's a nation and have signed the WIPO (World Intellectual Property Organization), you can find them in the above list as Holy See.

Yep, it's the only Holy See with status of nation.
 
I also thought Vatican was the official name, but this is copied from the WIPO page, so seems the real name accepted by other nations is Holy See.

The Holy Mountain of Athos (whatever it's actual name is) is also a state, but I don't know how it's special status is defined in the international community. They have a capital "city" and a government, the "Protaton", which consist of the council of protos (the leaders of the monasteries). They have their own legislation only on the matters important to them, for the rest they follow Greece's policy (like in external and internal affairs). They have their own economy laws, for example they don't apply some taxes, so if you buy a candle, an icon, an art album, a CD or something to eat, it will be around 30% cheaper than in inland Greece. They have foreigner rules: one has to get a residence permit in order to be allowed to enter; there is a bureau in the town where you take the boat to sail to the Mountain's ports (there is no terrestrial connection) which serves as a kind of consulate; one needs to take the short permit there, or show an invitation from one of the monasteries to get the extended permit.
