And if they're wrong, we should avoid debating them because they don't want you to? And if they're violent hate-mongers, we should just avoid criticizing them because they might attack someone? There is a massive gulf between what you're saying and the situation here. Quite simply, freedom of speech is necessary for any democracy to proceed. Feelings will be hurt, and that is an unfortunate necessity -- even if it is not hate speech, there can be no way to avoid offending those who believe something that simply isn't true. We can only condemn those who turn speech into violence. |

The most stringent protection of free speech would not protect a man falsely shouting fire in a theater and causing a panic. [...] The question in every case is whether the words used are used in such circumstances and are of such a nature as to create a clear and present danger that they will bring about the substantive evils that Congress has a right to prevent.
I interpret making that movie as to be similar to falsely shouting "Fire" in a crowded movie theater. Plain and simple. If you don't then you don't.
That is the end of my participation in this discussion for today. I have real work that I need to get done and must stop wasting time debating an argument that will never be agreed upon due to people's different philosophies and views on life.

I find this mind boggling.
1) Violent intolerant people create a situation wherein they will react violent to any criticism. 2) Someone levies a criticism or irreverent depiction where irreverent is defined by those in (1) 3) People in (1) commit violence to someone not even associated with the people in (2). 4) People in (2) share the blame for the actions of people in committing violence in (3). It's absurd. Look at the proximate, and second order proximate causes of the death resulting. The closest obviously being the people murdering, but even the second most important act in the causal chain would be the same people who set up the conditions described in (1). Those "inciting" could be argued to be fourth order even because the very terms and conditions of what constitutes an incitement gets defined by the people committing the murderous acts. |

If you want to dive into the language there, then the creating of an environment of "clear and present danger" would imply that the executors of the violence, the location, the victims, and the time would be able to be defined. So you're telling me that prior to these events, you would have been able to in a general way specify those 4 variables based purely on the movie? You're also ignoring the fact that shouting fire would be (1) false and (2) done for the sole purpose of inciting a riot. I'm not sure that the movie in question satisfies either of these two conditions. |
