Look we can go in circles on this but you can't divorce "a well regulated militia being necessary to the security of the state" from the amendment. Gun ownership is conditional on being part of the militia. We now have a National Guard. Back in the day we didn't. The National Guard is the well regulated militia that we are supposed to count on to defend us.

No it seems that common sense is a bit too difficult for you this morning. The lack of "self defense" or "hunting" in that amendment weren't an oversight by stupid people who wrote the damned thing. It doesn't say that you have an unlimited right to own whatever weapons you want to hunt humans.
When someone or some group is stockpiling weapons shouldn't we at least have law enforcement monitoring them? Now if you're going to trot out the old tired defense that we have to armed against our own government. It's not in the amendment either. Edited by Slartibartfast - July 22 2012 at 08:00 |

The Constitution does not grant rights to people as liberals like you seem to think. It assumes rights that already existed. The second amendment acknowledges that people already had the right to arms. In the 1770s, did people own guns who were not in the militia? The answer is yes. Did the framers of the Constitution see this as a problem and give the government the power to restrict gun ownership? The answer is no. Wherefore then your insistence on strict gun laws? "Shall not be infringed" sounds pretty unlimited to me. What part of "right of the people" (not the state) and "shall not be infringed" don't you get? |

Gun control arguments have been going on for years, and like the politics arguments and the religion arguments it will never be settled.
Contrary to one persons opinion, there is no lack of gun control laws. There are hundreds, if not thousands already on the books and more added all the time.
Even if there was a lack of laws it wouldn't make it easier for criminals to get guns because they get there guns illegally anyway.
And let's not confuse the theater shooter with common criminals who make their living by breaking the law.
Before the shooter walked into that theater, he was not a criminal. The fact that he legally purchased guns proves that he was able to correctly answer all the questions on the background check form.
He is mentally ill. He didn't do what he did because guns were readily available.

![]() I would hasten to add: Amendment X The powers not delegated to the United States by the Constitution, nor prohibited to it by the States, shall be reserved to the States respectively, or to the people. There is no provision for Federal gun control in the Constitution, therefore the most you could argue is that all such laws must exist only at the state level. |

Let's just dispense with all laws because it's inevitable people will break them. I suppose if everyone in the theater were packing heat they would have all concentrated their fire on perp and no innocents would have been hit. State's rights would have absolutely prevented this. What it the hell is the matter with you people?

That was a reason- certainly not the only one. The collapse of the United States government will not happen because of some violent overthrow (nay, its citizenry is more interested in getting others to pay for their entitlements). Our collapse will happen economically because our laws and programs are unsustainable. This may lead to violence- I don't know. |

Most caustic joke I've heard about removing the Penn State statute of Joe Paterno:
"The statue was unveiled in 2001, making it another 11 year old ruined by Penn State" I didn't follow this story very much, but I love justice. Now just completely dismantle all sports programs at all colleges and high schools. Then I might be a bit happier. f**k sports annoy me.
