Mike Portnoy has sued Dream Theater

According to Courthouse News Service, ex-DREAM THEATER drummerMike Portnoy filed a lawsuit against his former bandmates in April claiming that they "wrongfully excluded" him from the group and are "wrongfully using the name of the band in connection with [their] recording of an album without the participation or consent of [Portnoy]." In addition, the drummer's complaint, which was filed on April 27, alleges that the defendants — John Petrucci (guitar), John Myung (bass), Jordan Rudess (keyboards), James LaBrie (vocals), along with associated companies Ytse Jam, Inc. and Infinity Tours, Inc. — "are wrongfully using the name of the band in connection with the promotion of live performances by the individual defendants, without the participation or consent of [Portnoy]."

 

DT have a right to exclude persons from their band and to use the name Dream Theater in recording subsequent albums and live performances.

 

Portnoy was part of the band, but the whole band itself

 

Sounds like Portnoy is make some $$$ trying to get an out of court settlement so more $$$ won't go to pay future costs of lawyers who will probably get 90% of the settlement

Sheesh this is really getting sad for Mike.
Not that I feel bad for him, quite the opposite actually.
Increasingly sounding like his is just a...well lots of things I wont say.

Though it's good for DT fans he was out of after all. He would've been the end of the band.
