It was a sad outcome indeed, but at least her remains were found and she can be given a proper burial. Family and friends can say their farewells, come to terms with the loss and continue with their lives.

It's not a happy or a good ending - but at least it brings closure.

Thank you Bob.  My intentions of all the threads I started on the Web was to keep her name out there even in unorthodox places like this in hopes someone who saw or read would have known something.  

I appreciate everyone who read and looked.  I love all of you here.  I have been a member here approaching my 6th anniversary and I cannot express my deep appreciation to M@X and everyone involved with PA that it was here and available for not only my entertainment but more importantly as a source for my missing niece.

The heartfelt gratitude is extended to everyone in my PA family from all the members of The Amber Dubois family.   I will certainly keep you posted as any new details come to light.

and I'd like to add my personal gratitude to everyone from their support and thoughts.  There is a reason I love the forum....  it isn't the music...  it is shooting the bull with characters like you all.  It is a close-knit cyber community in spite of our petty musical differences. You have hearts of gold... and what you have shown Brian and his family says a lot about you all. 

Raff and I will have a candle lit tonight for Amber.. someone who has touched our lives very deeply through Brian and his family.  I took this news very ...very badly last night.  I really had dreams of meeting her when Raff and I finally go west to see Brian and our other Ca PA'rs and I planned on giving her a big ol' kiss on the cheek and telling her we were so happy she was home.. and tell her how she has touched so many lives.

In Amber's memory, I listened to the following songs: Daddy from Emerson, Lake, and Palmer; and Nobody's Hero from Rush.  I just felt them appropriate, and the emotion of these songs did cause me some watery eyes.

I have only just heard this news.  I am shocked and lost for words.  So all I shall say is that I am very very sorry for the loss of Amber and my thoughts are with her family and friends at this terrible time.

While there is some sense of closure in that we no longer wonder where that is now replaced with a burning fire for Justice for Amber and every other child that has had this happen.  Paraphrasing Maurice Dubois at the vigil last night:
 
Amber's favourite animal was the wolf. The wolf hunts in packs for their survival. So must we hunt the predators that threaten our children.

While there have been several laws that have been passed in this state regarding tougher laws for Sexual Offenders the ACLU has been able to get everyone of them overturned based on the rights of the predators. I think it is about time the rights of Amber, Chelsea and all the other children who have victims at the hands of these predators has to become more important.

We have a moment in time to affect real change. We all must take action. For all the tears that you have shed for Chelsea, for Amber an all the children tomorrow turn those into minutes to help protect our children and make our community safer.

 
Now my words:
 
We have locked elbows with some very high profile missing children's agencies and workers.  Mark Klass, The Laura Recovery Center, The Daniella Van Dam family and many others.  We have heard their stories, learned how to set up searches and organize our media efforts. We now could share this information with children gone missing in Washington, Oregon and most recently with the King family. We would like to not have to share our knowledge in this way again. First of all it is after the fact not prevention and second of all we don't want to see one more child possibly even your child be torn from their families again.   
 
Please be a positive light in your own communities. Help our family keep our Amber alive by demanding our representatives at all levels know our outrage and demand real change in how these types of criminals are handled in the future.  In the case of violent rape it should be one strike not 3.  Lets' look at who is in prison and why.  Should a person holding more than one ounce but less than one pound of marijuana really need to be locked up on felony charges?  That might eliminate 10% or more of the overcrowding now so that we can keep people like John Gardener from ever having a chance to repeat what he did.  As one expert said on the news this week he learned from the first conviction that he could not let his next victims live and testify against him.  In my opinion it would be rare that any such individual would not progress down that path that John Gardener took.  While this kind of predator needs to be stopped this doesn't even take into account all of those children taken into sexual slavery around the world.  Imagine your children being sold like  loaf of bread to be used by depraved minds and hearts. Human trafficking is fast exceeding drug trafficking as the leading criminal export.
 
Take a moment and look at your own children or nieces and nephews or just children in the neighborhood.  They literally can vanish in a blink of an eye.  I know first hand.  Yes law enforcement and the Judaical system needs to change. One thing we found out is the that your local police department will be ill equipped to handle such cases. Their lack of understanding has proven deadly to many children.  (You can find this fact coming from the Justice Department when you go looking for information in the first week your child goes missing)  The States need to provide such trained experts to assist the local departments when a case of this nature happens.  For example if the Esconidio Police did not stubbornly hang on the status that Amber was a runaway in light of all the evidence against it we might have the resources available to have found her sooner.
 
That being said in the end it really comes down to you and me and the question really is what are you willing to accept?  The news media and politicians point to voter malaise as a problem.  I disagree.  I believe our lawmakers are the one with the malaise and It is high time we make them accountable for what they are supposed to doing.  Get involved!

I'm with you Brian, I'm tired of those usefukl idiots protecting the rights of the criminal and forgetting who the real victims are, sexual predators can't be redeemed, if the state allows them to leave prison,they will rape again, but this time with more brutality  because they are full of anger and hate, plus of course coveruing their racks better because they have experience, if they are forced to take injections for chemical castration, they will buy testosterone by Internet and attack again.

Sexual crimes are not caused by sexual desire exclusively, but for hate, rage, or power over the victim, so even if the state manages to cut the sexual component, the hate and anger will still be there

How many more innocent girls and boys do wee need to understand this?

I worked in jails when doing my legal practices, and this guys are beyond redemption, I know it sounds like revenge, but I'm for death penalty in this cases, and if not, at least a life sentence without chance of parole.

I didn't wrote a word during the last year in this thread, because my words would had sounded fake, being that even when I wanted to have hope, the experience told me this wouldn't have a happy ending, that's why now I talk, because I share Brian's anger, this happens over and over, but nobody does a thing to stop it.
 
We must protect our kids, not the criminals.

well said Brian.  Debated as to whether to respond.. but I'll direct this personally to you... and I care only to hear your thoughts if you choose Brian...it is not an invitation for yet another political discussion for those that may not like or agree with they think.... though perhaps it might get through to some who really haven't thought about it.

I am very liberal in my politics, have never voted once for a Republican.. and never will. . Yet I feel far too much emphasis is given to protecting the rights of criminals and not enough given to what IS the primary function of government.  Not protecting special interests..be it those of the left... and especially those of the right... but protecting the rights and providing for the safety of it's people..  namely those who can't protect themselves.  Most definitely not for those who use the inherent freedom and protections in our laws as a shield against paying for their crimes. 

unfortunately I do think voter apathy is a large part of the equation though. Blaming Washington is like blaming the ingredients for a horrible dish that a cook f**ks up.  If events like the VaTech shooting could not get people off their asses to demand Washington do something about guns... to at least TRY... then nothing will.   People are simply too wrapped up in their own little worlds to give two sh*ts as to the larger ills in the world.  Perhaps that is me being too cynical... but I sure haven't seen much to get me to think that people really care for than the two feet in front of their faces.. and how things affect THEM personally.  Our politicians are no different..  they refect the voters that put them there. If people really considered the idiots the two parties put up before us as candidates. People so far removed from OUR REALITIES and concerns. Yet what do the voters do.. nothing... what can they do?  Not sure I ask myself why I am not as politically active as I was in my youth.  I believed in the power of change.. only to see politicians I believed that could be real instruments of change...  just get swallowed up in DC by the system.  That is probably the root of my disillusionment ...though I still never fail to vote.  I simply don't believe in the system...  nor the voters.  I do believe the US is morally rotten at the core.... too many divergent interests.. with unfortunately no consensus nor any incentive TO find any consensus to fix real problems in our society.

Since government can not. .and will not fix the ills of our society.  It is up to us... and groups like you mentioned Brian to try to fill the gap left by the apathetic public and a self-serving government.  I had a lot of hope for Amber's return... unfortunately I have none that this country will wake up and realize it's very severe problems at the core of our society.  It goes far beyond just saying the politicians are the problem..  we put them there.. we allow them to stay there.  We simply are too fractured a society to make a stand against problems like allowing predators to walk free and commit crimes...  or lunatics have guns and take scores of people out with them when they finally snap.

Iv'an I appreciate your insider looks into these guys who are just broken.  They are like a dog who bites once they start they will bite again.  There is something broken inside these guys that just can't be fixed. I don't know if it is a gene or is it environmental  it doesn't matter it has been proven time and again these guys will do it again and again.  They already have 3 other possible attempts this guy did that he is being investigated for outside of Amber and Chelsea.  One strike laws for violent sexual crimes needs to be passed.

I understand your skepticism and it is okay.  I have seen enough people who do care that showed up day after day to volunteer to find a little girl they had never met.  Those people care and I would never dishonor their service by not pushing forward.  Some things are easy. 

This bill called the Adam Walsh bill was passed into law in 2006.  Yet it has never been funded.

Surely several hundred thousand letters with some high profile parents of murdered kids leading the way would finally get this into law.  Other things I  called for might not take much more than a state referendum to pass. These things are neither democrat or republican, left or right, liberal or conservative.  They are things that affect us all.  One group who is considered left who motivation I question in such cases is the ACLU.  The blood of these kids are on their hands because of there unrelenting prosecution of laws passed by both the voters and the legislatures to say there is no difference between a sex offender and any other type of criminal.  We need to understand why do they feel that the rights of these people are higher than those of their victims and potential victims. 

Politicians really have no agenda except reelection.  They will vote with whatever way they feel will get them so.  So if enough people get together to say something they usually listen. It has happened before.

I couldn't agree more.  My skepticism is with the system... and the people in general that listen to demagogues on the right.. and the  left that  just drive this country apart. Making acting on such important issues as this impossible.  What we do have... are many caring and wonderful people. Those you saw there.. and those I see here that have had Amber touch them so profoundly.

I've already had my hand slapped for being 'political' in this thread, so I'll keep my comments level.
 
Families are devastated by this kind of thing.  I needn't really even say that to anyone visiting here.  I've had friends who've lost children under far more reasonable cirumstances (i.e., illness, not murdered).  I am blessed that every time I dropped my son or daughter off at the school bus stop, or let them walk to school, they came home in the afternoon.  We were able to push through some safety measures in the city (no sidewalks, cars parking on shoulders, kids walking in streets  Fix it.).  Baby steps, in comparison.  We were not able to stop the surprisingly frequent notices, and evening meetings at the school, that "oh, by the way, a Level 3 sex offender now lives within a mile of the school so you might want to keep an eye on your children."   Never explained:  why is that now my children's problem?  Never explained:  why is this allowed?
 
It seems that given the national coverage that Chelsea, and Amber now, have received, maybe some good can come of this.  Even up here in Seattle there's been coverage of Amber's memorial yesterday.  Obviously, if not for the site, it would have just been another news bite for me.  It was so good to see a celebration of a life, and a remineder that all too frequently there are some young girls who in these parts who never came home from an innocent walk home from playing with a friend. 
 
Politically, I'm as jaded as can be.  I grew up during the Viet Nam era, when an 18 year old who had no right to vote could summarily be drafted and sent off to battle in the jungle.  We were able to make changes, so that now an 18 year old can vote. 
 
Change can happen.  Fight the good fight.

Governor directs state to keep parole records of sex offenders

That was fast. Just hours after Assemblyman Nathan Fletcher, R-San Diego, slammed state officials for a policy allowing the destruction of parole records, Governor Arnold Schwarzenegger decreed an end to the practice.

The governor directed the California Department of Corrections and Rehabilitation "to retain all files on sex offender parolees going forward and to make as much information as possible available to the public," according to a statement from his office.

"The current practice of not keeping information on sex offenders in California is unacceptable," he said. "It is in the best interest of public safety to retain all information on these individuals and to make as much information as possible available and transparent. I have directed my Department of Corrections and Rehabilitation to end this practice and immediately begin keeping all sex offender parolee files."

At issue are the parole records of a John Gardner, the registered sex offender accused of murdering San Diego teenager Chelsea King. He's also a suspect in the murder of another teen from the area, Amber Dubois. Check out more on Flether's earlier presser here.

UPDATE: Corrections Secretary Matthew Cate issued a statement this afternoon, adding that the department will retain all sex offender parole documents "effective immediately" and keep them indefinitely.

"I have directed my parole staff to immediately retain all information related to sex offenders. We will continue to support local law enforcement in their investigation into this matter."

As I see the US from the outside, from a country with a mere 5 million people people that are astonished that maybe 50 murders in total will be committed this year if the bad opening of the year continues, where we have guns in every other home but rarely cases of gun-related incidents (and the majority of these from foreign-based or controlled crime gangs) and perhaps one such child disappearance every 5th year or so, I think there are many issues to deal with.

A system that manage to take care of those falling outside of the work environment being the most important. To prevent children from growing up in homes where the parents doesn't function. To take children away from parents clearly not able at parenting as soon as possible, when early guidance from competent people hasn't had the desired effect. If whatever person responsible for this particular crime has such a background I guess is still unknown - but the majority of these cases seems to be done by people living in less than desirable conditions (to put it mildly), damaging their souls and personalities for life. Preventing that from happening should be high on the list.

A system for handling those that doesn't get rescued from such situations is a next. Sex offenders are treatable to some extent, but the fallback rate is on level with heavy drug abusers. Most are not treatable, and should be handled as such. Some will be born without empathy and have a fault in their genes that will make them predators no matter what, and for them it's a matter of locking them up and throwing away the key (or by preference melting it).

Others will be damaged by their upbringing, and those in this category does contain the salvagable cases. People subjected to torture of various kinds in their childhood - physical abuse, sexual abuse, in general subjected to various forms of dysfunctional environments. Society should obviously be sheltered from such individuals, but as long as some of these cases might be treated to become functioning people such treatment should be given. If not for anything else than to find the ones worth treating. Most cases will be too damaged though, and will have to be taken out of society.

But to be able to do what's briefly outlined above a major system has to be in place. Social welfare, a security net that makes it possible for people to get through economically. In the case of the US a better minimum wage system by law as well as getting on par with the rest of the western world in terms of law-given vacations (the latter a field where even Japan has a better system than the US) would be a good start. Wages that makes it possible for people to get by with one full time job and paid vacation for 2-3 weeks a year would take care of many problems - and would have a major positive effect -in the long run- to prevent cases like these.

For short term effects some legislation would have to be dealt with though. The prevention of people growing up to be monsters is a long haul where the results doesn't show themselves for 20 years or more. And the monsters created meanwhile will live - on average till they are 75 or so. Finding and dealing with them in a manner that prevents them from harming society is and will be a major challenge anyway. And even if measures should be taken right now in the prevention department, that means that there are still 75 years ahead of the US with monsters already created that needs to be handled in a way that prevents them from damaging others. Where finding them arguably may me the major challenge.

One way to track them down is to start tracking people with abnormal behaviours. Flashers will often indicate a person in a sloe evolvement to become a molester. Those who abuse prostitutes will often abuse others as well, and it is well known that those people in some circumstances may move on to abuse others as well. Many of them are established abusers in their home situation, and represents a danger to society at large if that home relation falls apart for instance.

It is also well known that monsters like these seek out powerful positions if they can. Sport leaders (especially trainers of children and youths) and religious organizations (smaller, secteric ones in particular) are known as the fields where these predators most often will establish themselves.

I could go on and on here - but I'll stop with these brief, initial descriptions. As a few scraps of food for thought.

I am sorry Windhawk it is our experience here in the USA  that violent sexual predators almost always strike again no matter what type of rehab they go through.  An evaluation of Mr Gardener at his trial in 2000 said that he was not a candidate for rehab and would almost assuredly  repeat his crimes.  Yet the prosecution attorney still accepted a plea bargain for 6 years of a crime that carried a maximum sentence of 30 years.  (If you don't know Mr Gardener attempted rape on a 13 year old girl when he was 22.  He beat her so bad she almost lost her eye.)  Here in lies the broken system.  If he served his full sentence there would be two girls still alive today including Amber.   There is no doubt in my mind that a violent sex offender acts out they should be put away for good.  Even if you feel there is rehabilitation in them akin to a drug user remember the drug user is not committing a violent crime on another person and even greater importance on a  a minor.  He doesn't bury a body in a shallow grave to hide what he has done.  If they repeat their crime the only damage in the majority of cases is usually to themselves. 

I am past rehabbing a violent sex offender. We have been trying to do it for years and all we get is more dead  boys/girls/women.  I have no sympathy for them and they do not have remorse.  Re-read what Iv'an wrote among those he was around. It is not relegated to the USA.

This thread is not for debate on the rehabilitation of the sex offender. It is about Justice for people weaker than those that attacked them.  It is neither left nor right. It is about keeping our kids safe. Megan's law in California has helped keep some of these guys out of youth roles you mentioned but we need to take it farther. 

Our biggest challenge is not to wash in the 18/19 year olds having consensual sex with their 17 year old girlfriends.  We need to do a better job to separate the rapists and the pedophiles from this group. 

Here is a very good article illustrating my points above. The one thing she does not mention is there may be as many as four attempted abductions that Gardener is being investigated for both in San Diego County and the adjacent Riverside County beyond Chelsea's and Amber's murders.  and I  will add one sentence to the end of her article she chose not use.

If this doesn't pan out to be Gardener alone then then that means there is a another predator on the lose in Northern San Diego County
