I have had a request, from a band who are in the archives, for links to or extracts from material published on this site. 

Since the material in question was written by me, I have very few problems with this.

I've seen that loads of other sites quote stuff from here freely - often uncredited, which is less flattering - and have often wondered what would happen if PA decided to protect its material.

The way it appears at the moment is that PA is perfectly happy to freely spread it all around - which principle I fully support, as long as the writer and this site are credited. We do this because we love doing it, not because of the huge sacks of money that Max is always sending us... LOL

But it may be in the future that others begin to profit from stuff they've taken from here - and PA may then decide it wants more control over work which essentially belongs to this site (which is equally supportable). I'd guess that this has already been considered but was wondering where we currently stand with this.

Bottom line; Is it OK for bands/other websites to copy reviews, bios or blog entries from here - or should they get permission from PA's owners? Is it enough for the original writer to give consent, is no consent needed, or should consent be given officially through the site's legal team?

How do we stand legally on this?

I think it's fine if bands decide to put on their websites PA reviews or to use it in other purposes, with, of course, giving homage to PA. It'd help as for band, as for PA.

Thanks for the link to the Legal notice - guess I was just being lazy.

"Please note that all the intellectual work you supply (reviews, articles, forum posts etc.) to the ProgArchives is also your property and you will be considered responsible for the contents you submitted even in case of it being accepted scrutiny from the administrators."

Therefore if anyone asks me if they can use the stuff I've written on their site, they only need ask my permission.

"This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose that is not expressly permitted by the ProgArchives."

...and if anyone copies stuff from here without asking nicely, then they're breaking the rules and should be punished Evil Smile

I suggest a month tied to a chair being forced to listen to this year's Eurovision entries - preferably with "Dum Tek Tek" as every other song...


However, the very first paragraph contradicts things slightly; 

"The ProgArchives refers to the individuals who owns,administer, maintain, and manage this site, its presentation, and its software. It does also refers to the administrators that were empowered by the owners to acts as moderators and developers. However it does not refer to the collaborators listed on the collaborator page."

Because the earlier passage I quoted read "not expressly permitted by the ProgArchives."


So I'm still a bit confused - should I simply give my own consent, or, because I am but a humble collaborator, should I recommend that the band/website manager contacts Max or Roni?

I've elected to do the latter in this case, just to make sure, as the guy I've been speaking to has already informed me that the band intend to release a CD in the upcoming months - so they would clearly like additional promotional material.

Oh no ! Shocked I`ve got a link on my personal website but it just goes to my profile & reviews. Am I safe from the long arm of the law?
