The ownership of the title is currently a very hot legal potato. Whilst I couldn't state what is exactly happening, I do know what is generally taking place. There should be a result later this year which should rectify matters in favour of all five core members. There are elements of legality, morality and integrity involved here.
I honestly don't know the full details of the G'n'R story. If Axl feels vindicated in doing what he does - it might be because he owns the name. I really don't know either way. I actually got that album and quite like it. I don't know whether it is a G'n'R album or not. Probably not on reflection, due to the absence of a core group of original members. However, it is possible he owns the brand/name. He may have bought the rights from the others. I don't know. The point is that in the case of Wishbone Ash - the other band members and business partners (because it was and is a business entity) never did sell or forfeit their ownership and residual rights etc. Wishbone Ash - name/brand/legacy/business - belongs to them all.
As I have said elsewhere - Ringo could form a band with some unknowns and go out as The Beatles. Obviously, it wouldn't be the Fab Four and one wonders how long he would succeed until a stop was put to such disingenuous activites. The whole thing would inevitably end up in the courts and would become merely a source of gain for the lawyers alone. I'm sure you can appreciate the analogy. What would make matters worse would be if Ringo tried to prevent the others (or other in this case) from doing the same.
Sadly, such is the case with Wishbone Ash...

I am more than aware of this matter. However what cannot be doubted, is that the band are using the moniker 'Wishbone Ash' regardless, thus they cannot really be called anything else unless THEY change the name that they have adopted, even though the band are representing the original Wishbone Ash grossly inacurately with only the frontman of that lineup appearing. Sadly, it is true that they ARE Wishbone Ash in a corporate (ownership of the title) sense no matter how you or anyone else feels about the authenticity of the whole thing. Just the same as Chinese Democracy being released and toured under the name Gun's And Roses when really it's just Axl Rose's solo project... it's still named as Gun's And Roses.

Glad you enjoyed it but it was not Wishbone Ash despite what it might have said on the tickets.
If Steve Upton, Ted Turner and Martin Turner all object to Andy Powell's continuous hijacking of the name (applied to whoever happens to be on his payroll that month) then it can't be considered a genuine Wishbone Ash. It is misrepresentation. It is a con. However, that is not to say they aren't a good band in their own right. If they went out as either Andy Powell's Wishbone Ash or the Andy Powell Band (performing the music of Wishbone Ash) then things would be more simple and honest. However, he knows only to well that this would lead to a severe fall in attendances, and so sadly he perpetuates the fallacy.

Seen Wishbone Ash in Fife back in 2004. Great little concert hall, great sound quality, great version of 'Phoenix' for the finale, great 'cause I got to meet Andy Powell after the gig. What more can I say?

You were lucky. You saw the WA#2 (L.Wisefield) line-up which were one of the two 70s classic original versions.

You were also lucky seeing the reformed original WA#1 (T.Turner) line-up.
Sadly, since about 1996 all versions of the band appearing as Wishbone Ash have been completely bogus with just one original member and a revolving group of paid salaried sidemen. Not Wishbone Ash as such, but the Andy Powell band masquerading as Wishbone Ash.

I got a chance to see Wishbone Ash in a small club in Madison, WI, in 1987, and I was thoroughly blown away. The intimacy of the setting was so much better than seeing them in a stadium or large concert hall. It seemed like the original lineup, too. One of the best concerts I've ever seen! Even though the audience was small, they played as if we were the most important fans in the world.

Looks like I was the only lucky one tonight!
This was the gig I enjoyed best from Ash over the last few years. Aside from a couple of problems with Andy Powell's guitar - think he 'stomped on a cable', it was a very tight performance all round.
Amongst the highlights, Sometime World, Way Of The World (I've been waiting for them to play this for the last 3 times I've seen them), and a fantastic rendition of Phoenix as one of the encores.
Interestingly, I bought a CD after the show which was a performance recorded by the band in May 2008 on a US Radio station (XM) which included a full recording of Argus, by the line-up I saw tonight, namely Andy Powell, Jyrki 'Muddy'' Manninen, Bob Skeat & Joe Crabtree (very good performance tonight).
Had a quick chat with Andy Powell afterwards, and got him to sign the CD (will get an airing on my way to work tomorrow).
Bob Skeat (bass) was eyeing up my missus in the bar afterwards (saucy!). I think she might be taller than him though!
Long live rock and roll!
Next gig at the Stables will be Think Floyd in exactly 1 month's time.
