No, it's Chris "Judge" Smith: co-founding member, and actually, the guy who had come up with the band's name. And Jackson wasn't still in the band: the bass player is not Potter, but Keith Ellis.

Hammill, Smith, Banton (on his knee), Evand, Ellis.

The band is VERSUS X. Got myself a copy of "Distrubance" only recently, and boy, was I stunned by this demonstration of somber magic and virtuosity.
